Terms of Service

Acceptance of terms

By accessing or using WriteHook at writehook.app (the "Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use the Service. In these terms, "WriteHook," "we," "us," and "our" refer to WriteHook and its operator. "You" and "your" refer to you as a user of the Service.

Description of service

WriteHook is a free, browser-based songwriting tool. It provides lyric writing, chord progression building, audio playback, recording, and related creative tools. The Service is provided at no cost. There are no paid tiers, subscriptions, or premium features.

Eligibility

You must be at least 13 years old to use WriteHook. If you are under 18, you should use the Service under the supervision of a parent or guardian who agrees to be bound by these terms. Any use of the Service by anyone under 13 who is not directly supervised by a parent or guardian is prohibited. By using the Service, you represent and warrant that you meet these eligibility requirements.

Your account

Account creation is optional. You may use WriteHook without an account, in which case your data is stored locally in your browser and never reaches our servers. If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us promptly if you become aware of any unauthorized use of your account.

License to use the service

Subject to these terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use WriteHook for personal and commercial songwriting purposes. WriteHook reserves all rights not expressly granted in these terms. We may terminate this license at any time for any reason.

Prohibited activities

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation
  • Attempt to gain unauthorized access to any part of the Service, its servers, or its infrastructure
  • Interfere with or disrupt the Service, its servers, or networks connected to the Service
  • Upload viruses, malicious code, or other harmful content through the Service
  • Use automated tools, robots, scrapers, or similar methods to access or collect data from the Service
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity
  • Use the Service to harass, abuse, threaten, or harm others
  • Use the Service to create, store, or distribute content that is unlawful, defamatory, obscene, or that promotes discrimination, hostility, or violence
  • Copy, reproduce, or imitate the look, feel, or design of the Service without prior written consent
  • Use WriteHook's name, logo, or trademarks in any way that could tarnish or misrepresent the Service

We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We may also suspend or terminate your access to the Service if we determine, in our sole discretion, that you have violated any provision of these terms.

User content and ownership

You retain full ownership of all content you create using WriteHook, including lyrics, chord progressions, melodies, recordings, and notes ("User Content"). WriteHook claims no ownership rights over your User Content.

By using the Service with an account, you grant WriteHook a limited, non-exclusive, worldwide license to store, process, and display your User Content solely for the purpose of providing the Service to you. This includes allowing you to access, edit, and sync your content across devices. This license exists only while your account is active and for a reasonable period afterward in case you wish to reactivate your account. It does not give WriteHook the right to distribute, publish, or use your content for any other purpose.

You represent and warrant that your User Content does not violate any third party's rights, including intellectual property rights, privacy rights, or publicity rights. You are solely responsible for your User Content and the consequences of sharing or distributing it. WriteHook does not review, monitor, or endorse User Content and assumes no liability for it.

WriteHook proprietary content

The WriteHook name, logo, user interface design, graphics, and branding are the property of WriteHook. All intellectual property rights in the Service itself (excluding your User Content) belong to WriteHook. You may not copy, modify, distribute, sell, or create derivative works based on any part of the Service's design or branding without prior written consent.

Content licenses for presets and sounds

All chord progressions, rhythm patterns, strum patterns, drum sounds, instrument sounds, and other built-in creative presets in WriteHook are provided to you royalty-free. You may use them in your personal or commercial songs, recordings, and performances without attribution or additional payment.

You may not redistribute, resell, or repackage WriteHook's presets, sounds, or creative assets as sample packs, templates, or in any product that competes with WriteHook. In short: use them freely in your music, but do not copy them to build a competing tool.

Feedback and suggestions

If you submit feedback, ideas, or suggestions about the Service (via email, Discord, or any other channel), you grant WriteHook a non-exclusive, royalty-free, perpetual, irrevocable license to use, modify, and incorporate that feedback for any purpose without any obligation or compensation to you. Submitting feedback does not create a confidential relationship, and WriteHook is free to use similar ideas from any source.

Donations and payments

WriteHook is free to use. Donations made through Ko-fi are entirely voluntary and do not grant any additional rights, features, or obligations beyond what Ko-fi's own terms provide. Donations are non-refundable. WriteHook does not process payments directly; all payment handling is managed by Ko-fi and its payment providers.

Privacy

Your use of WriteHook is also governed by our Privacy Policy. By using the Service, you acknowledge that you have read and understood the Privacy Policy and consent to the collection, use, and disclosure of your information as described in it.

Security

We take reasonable measures to protect the integrity and security of the Service and your personal information. However, no system is completely secure, and we cannot guarantee that unauthorized third parties will never be able to access your data. You acknowledge that you use the Service and provide your information at your own risk.

DMCA and copyright claims

WriteHook respects intellectual property rights. If you believe that content accessible through the Service infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (DMCA) to david@writehook.app. Your notice must include:

  • A physical or electronic signature of a person authorized to act on behalf of the copyright owner
  • Identification of the copyrighted work that you claim has been infringed
  • Identification of the material that is claimed to be infringing and its location on the Service
  • Your contact information, including address, telephone number, and email address
  • A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
  • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner's behalf

WriteHook may, in appropriate circumstances, terminate the accounts of users who are repeat infringers of intellectual property rights.

Third-party links and services

The Service may contain links to third-party websites and services, such as Ko-fi and Discord. WriteHook does not control, endorse, or assume responsibility for any third-party sites, their content, or their privacy practices. Your use of third-party services is at your own risk and subject to those services' own terms and policies.

Indemnification

You agree to indemnify, defend, and hold harmless WriteHook and its operator from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney's fees) arising from: (a) your use of or access to the Service; (b) your violation of these terms; (c) your violation of any third party's rights, including intellectual property, privacy, or publicity rights; (d) your User Content; or (e) any other party's access to and use of the Service with your account credentials.

Disclaimer of warranties

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, WriteHook disclaims all warranties, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. WriteHook does not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components. Any content obtained through the Service is accessed at your own risk.

Limitation of liability

To the maximum extent permitted by applicable law, WriteHook and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, goodwill, or revenue, arising from your use of or inability to use the Service, even if advised of the possibility of such damages.

WriteHook's total liability to you for any claims arising from or related to these terms or the Service shall not exceed the total amount you have paid to WriteHook in the twelve months preceding the claim. Since WriteHook is a free service, this amount is zero.

Some jurisdictions do not allow the exclusion of implied warranties or the limitation of incidental or consequential damages. In those jurisdictions, the above limitations may not apply to you in full. These terms give you specific legal rights, and you may also have other rights that vary by jurisdiction.

Governing law and dispute resolution

These terms are governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict-of-law provisions. Any disputes arising from or relating to these terms or the Service shall first be addressed through good-faith negotiation between the parties. If negotiation does not resolve the dispute, you agree to submit to the personal jurisdiction of the state and federal courts located in the State of New York.

General provisions

Severability. If any provision of these terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

Assignment. WriteHook may assign or transfer these terms, and any rights and licenses granted under them, without restriction. You may not assign or transfer these terms or any of your rights without our prior written consent.

Entire agreement. These terms, together with the Privacy Policy, constitute the entire agreement between you and WriteHook concerning the Service and supersede any prior agreements or understandings.

No waiver. The failure of WriteHook to enforce any right or provision of these terms shall not constitute a waiver of that right or provision.

Changes to these terms. WriteHook may modify these terms at any time. When we make changes, we will update the "Last updated" date at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the revised terms. We will make reasonable efforts to notify users of significant changes via email or a notice within the Service.
